The court’s decision follows a petition by Hassan, who claimed that videos depicting her were shared on social media with the intent to tarnish her reputation and subject her to public humiliation.
Justice Jobin Sebastian directed the magistrate to reconsider the matter after the First Class Magistrate Court‑IX had declined to direct the police to register an FIR and investigate the allegations. In her petition, Hassan argued that the magistrate treated her complaint as a private matter and merely asked her to produce evidence, instead of ordering a police inquiry under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
Hassan’s complaint alleges that Lakshmipriya and two others circulated the objectionable videos on social media with the aim of damaging her reputation. She maintains that the act constitutes defamation and was intended to subject her to public humiliation.
After the magistrate’s refusal to order a police investigation, Hassan approached the High Court, seeking a more thorough examination of the claims. The court’s directive now compels the magistrate to re‑evaluate the case and consider the possibility of a police investigation into the alleged defamation.
